1. Acceptance of Terms

By accessing or using ScopeAtlas (“the Service”), operated by ScopeData, Inc. (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

ScopeAtlas is a healthcare research platform that provides AI-powered analysis of medical literature, clinical trial matching, knowledge graph building, and personalized health insights. The Service is intended for healthcare professionals, researchers, and authorized users.

The Service does not provide medical advice. All AI-generated content is for informational and research purposes only and should not replace professional medical judgment.

3. Account Registration

Access to ScopeAtlas requires an approved account. You must provide accurate information during registration and keep your credentials secure. You are responsible for all activity under your account. Notify us immediately at security@scopedata.ai if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable regulations.
  • Attempt to re-identify de-identified health data.
  • Share access credentials with unauthorized individuals.
  • Reverse-engineer, scrape, or systematically extract data from the Service.
  • Upload malicious code, viruses, or content that could compromise system integrity.
  • Use the Service to make clinical decisions without independent professional verification.

5. Your Data Protection Rights (GDPR)

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have the following rights under the General Data Protection Regulation (GDPR):

  • Right to Access (Art. 15) — You may request a copy of all personal data we hold about you. Use the data export feature in Settings or email us.
  • Right to Rectification (Art. 16) — You may correct inaccurate personal data via your profile settings or by contacting us.
  • Right to Erasure (Art. 17) — You may request deletion of your personal data, subject to legal retention obligations (e.g., 7-year audit log retention under HIPAA).
  • Right to Restriction (Art. 18) — You may request that we restrict processing of your data while a dispute is being resolved.
  • Right to Data Portability (Art. 20) — You may receive your personal data in a structured, machine-readable format (JSON).
  • Right to Object (Art. 21) — You may object to processing based on legitimate interests or direct marketing at any time.
  • Right to Withdraw Consent (Art. 7(3)) — You may withdraw consent at any time without affecting the lawfulness of processing based on consent before withdrawal.
  • Right Not to be Subject to Automated Decisions (Art. 22) — Clinical trial matching results are reviewed by human coordinators before notification.

6. Health Data & Compliance

The Service may process health data classified as special category data under GDPR Article 9. We process such data only with your explicit consent or as otherwise permitted by law. We comply with HIPAA, GDPR, and applicable state privacy laws.

Health data shared with third-party processors is de-identified using the HIPAA Safe Harbor method. All processors are bound by Data Processing Agreements (DPAs) and EU Standard Contractual Clauses (SCCs).

7. Intellectual Property

The Service, including its software, design, and content, is owned by ScopeData, Inc. and protected by intellectual property laws. You retain ownership of data you upload to the Service. By uploading data, you grant us a limited license to process it as necessary to provide the Service.

AI-generated outputs (analyses, insights, hypotheses) are provided as-is. You may use them for your research purposes, but ScopeData makes no claim of ownership over AI-generated content derived from your data.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, OR NON-INFRINGEMENT.

AI-generated content may contain errors or inaccuracies. The Service is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider for clinical decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCOPEDATA, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your access if you violate these Terms. You may delete your account at any time. Upon termination, we will delete your personal data in accordance with our Privacy Policy, subject to legal retention obligations.

11. Changes to These Terms

We may update these Terms to reflect changes in our practices or legal requirements. Material changes will be communicated via email and in-app notification at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. For users in the EEA, nothing in these Terms affects your statutory rights under GDPR or local consumer protection laws.
